Чому справа проти Кирила Шевченка – політична

Чи є справа екс-голови НБУ Кирила Шевченка політичною? Безперечно. Це стало остаточно зрозуміло після клопотання НАБУ про продовження термінів слідства, яке, схоже, готовий задовольнити ВАКС.

Якщо подивитися формально, то все начебто дуже зрозуміло. Я і сам іронізував з цього приводу, бо особистої симпатії до Шевченка не маю.

Але коли НАБУ після майже 4 (!!!) років "розслідування" просить ще один, п’ятий (!!!), на тлі того, що вже оголошені підозри та розшук, то для мене, який ніколи не плекав теплих почуттів до екс-голови НБУ, стає очевидним – "доганяють". Справа не в тому, що трохи не вистачило часу. А в тому, що потрібно саме так.

Якщо не про мої симпатії, то проти високопосадовця такого рівня навіть справа про штраф перетворюється на політичну. Нагадаю, що посада голови НБУ входить до топ-5 за впливовістю у державі. Причина у тому, що він "сидить на грошах". Контролює платежі, керує власним фінмоніторингом, має доступ до банківської таємниці та навіть "друкує гроші". Причин мати на гачку голову НБУ більше ніж достатньо.

Простежте історію справи Шевченка. Їй майже 4 роки. Але ж це не біном Ньютона і навіть не справа Майдану. Це навіть не щось про діяльність Шевченка на посаді НБУ. Це справа про типову для українських банків тему співпраці з корпоративними клієнтами.

Скажіть, ну що там розслідувати 4 роки? А головне, якою є справжня мета? Відповідь не у тому, ЩО розслідувати. Відповідь у тому, що комусь потрібно, аби справа існувала. Я навіть не здивуюся, якщо НАБУ захоче розслідувати її ще рік чи два після того, як скінчиться п’ятий рік. Бо коли справа прийде до суду, вона може легко розсипатися. Але доки триває розслідування, підозрюваний знаходиться на гачку. І на нього можна тиснути.

Якщо справу затягують, кому це вигідно? На жаль, вже багато разів Національне антикорупційне бюро робило речі, які можуть бути вигідними чинному президенту. Звісно, це не ті відносини контролю, коли МВС, СБУ та Офіс генпрокурора виконують вказівки Офісу президента. Назвемо ці відносини "співробітництвом". За моїми власними спостереженнями, воно почалося ще за Порошенка. Вже тоді НАБУ почало хворіти на часткову сліпоту. Бачили "Роттердам", але не бачили оборудки Порошенка чи справу Рожкової.

Зеленський наслідував співробітництво з НАБУ. Маємо ту саму вибіркову сліпоту. НАБУ геть "не бачить" корупції у підозрілих операціях на мільярди гривень. Наприклад, картель у "Великому будівництві", справу про фітнес-тренерку дніпропетровського губернатора чи пригоди Труханова. Головний приклад: Ігоря Коломойського чемно запрошують, щоб відпустити через 40 хвилин. Це при тому, що вже багато років тому проти нього висунули звинувачення у розкраданні $5,5 млрд і зараз, під час війни, він активує процеси з повернення Привату.

І ось тобі – дрібнесенька справа Шевченка. Яку розслідують 4 роки, і аж ніяк. А справа в тому, що її треба тягнути.

З Шевченком відбувається така класика, що навіть не вірилося. Справу проти нього активували напередодні призначення головою НБУ. Навмисно призначили на таку впливову посаду, незважаючи на справу. Потім справа "кудись поділася", проте закрита не була. Мовляв, якщо не робитимеш що треба – маємо на тебе справу. Це дуже типова схема.

І ось, десь рік тому справа "знайшлася". Я не знаю, за якими саме пунктами Шевченко мав бути більш зговірливим. Підозрюю, що мова є про недостатню активність друкарського станка. Власне, ті ж претензії були до його попередника Смолія. Мало-мало-мало грошей, я хочу ще трохи більше. Спочатку для "Великого будівництва", а потім для наповнення бюджету під час війни з росією. Хоча зрозуміло, до чого може привести масштабна емісія. І не в останню чергу через впертість керівництва НБУ курс зараз 40, а не 60. Серед інших причин кажуть, що від нього хотіли призначення до НБУ людей Єрмака. Можливо, мені важко сказати.

Але є безперечний факт: більше ніж півроку тому пішли активні розмови, що Шевченка хочуть замінити на Андрія Пишного. Пишний має одну беззаперечну перевагу – він кум голови Офісу президента Андрія Єрмака. При тому, що він людина далеко не бездоганної репутації.

Головним аргументом на користь заміни було "Пишний кращий за Шевченка". Чим кращий? "Обіцяв робити те, що не схотів робити Шевченко".

Про що саме мова, не знаю. Поки що Пишний продовжує робити усе те, що робив його попередник. Так само зберігає високу облікову ставку. Але можливо, що його головні справи ще попереду. Вже пішли розмови про її зниження. Наразі Пишний виконує кадрову чистку НБУ, звільняючи людей Шевченка та розставляючи на посади колишніх співробітників "Ощадбанку".

А ось ще один факт на користь політичного тиску. Одна з перших справ Пишного на посаді голови НБУ – це перевірка "Укргазбанку", який очолював Кирило Шевченко до призначення у НБУ. На одному із засідань Пишний розповів, що знайдено близько 2000 порушень. Коли один з банкірів не стримався та засміявся, Пишний сказав, що може надіслати перевірку до нього та знайти стільки ж порушень у нього. Банкір більше не сміявся.

Це свідчить про те, що Пишний діє синхронно з НАБУ. Впевнений, що це не бажання допомогти слідству. Власне я більше повірю у варіант, що завдяки слідству та перевіркам здійснюються масові кадрові зміни. Людей Шевченка змінюють на людей Пишного. Якщо ця гіпотеза є вірною, про цю справу забудуть, щойно кадрові зміни завершаться.

Саме так виглядає типове зведення рахунків у стилі Володимира Зеленського та керівника його Офісу. Особливість стилю полягає у тому, щоб створити тиск з боку правоохоронців – але робити вигляд, ніби це не вони. Що самі вони – навпаки друзі, які допомагають, чим можуть. Хоча все вказує – це таки вони.

Зараз є модним розглядати НАБУ як лицарів світла, які єдині в Україні полюють на злодіїв. А як на мене, їм ще треба відмити свою репутацію. Від моменту створення було надто багато випадків, які б я назвав "співробітництвом" НАБУ із чинною владою. Справа Шевченка – одна серед багатьох.

Набагато важливішими виявилися ті справи, які НАБУ закрило або навіть не відкрило. Гадаю, якщо справи не закривають – це теж комусь потрібно.

Дуже чекаю справи проти корупції на "Великому будівництві" чи принаймні про оборудки уряду. Тоді я буду розуміти, що НАБУ виконує свою функцію, а не садить на гачок тих, на кого вказали в Офісі президента.

Why the case against Kyrylo Shevchenko is political

Is the case of ex-NBU Head Kyrylo Shevchenko political? Definitely. This became finally clear after the NABU's request to extend the terms of the investigation, which, it seems, is ready to satisfy the High Anti-Corruption Court (HACC).

If you look formally, everything seems to be very clear. I myself was ironic about this, because I have no personal sympathy for Shevchenko.

But when the NABU, after almost 4 (!!!) years of ‘investigation’, asks for another, fifth (!!!), amid the suspicions and searches that have already been announced, it becomes obvious to me, who has never cherished warm feelings for the ex-head of the NBU, that he is persecuted. It's not that there was a little lack of time. The fact that they need it that way.

If we speak not about my sympathies, then against a high-ranking official of this level, even a fine case turns into a political one. Let me remind you that the position of the head of the NBU is among the top five in terms of influence in the state. The reason is that he literally ‘sits on the money’. He controls payments, manages his own financial monitoring, has access to bank secrecy and even ‘prints money’. There are more than enough reasons to keep the head of the NBU hooked.

Trace the history of Shevchenko's case, which is almost 4 years old. But this is not Newton's binomial or even the case of the Maidan. This is not even something about Shevchenko’s activities as the NBU. This is a case about a typical topic of cooperation with corporate clients for Ukrainian banks.

Tell me, what's there to investigate for 4 years? And most importantly, what is the real goal? The answer is it is not WHAT to investigate. It is that someone needs the case to exist. I won't even be surprised if the NABU wants to investigate it for another year or two after the fifth year is over. Because when the case comes to court, it can easily crumble. But while the investigation continues, the suspect is on the hook. And you can put pressure on him.

If the case is delayed, who benefits from it? Unfortunately, many times the National Anti-Corruption Bureau has done things that can be beneficial to the current president. Of course, this is not the kind of control relationship when the Ministry of Internal Affairs, the Security Service of Ukraine and the Prosecutor General's Office follow the instructions of the President's Office. Let's call this relationship ‘cooperation’. According to my own observations, it began under Poroshenko. Even then, the NABU began to suffer from partial blindness. We saw ‘Rotterdam’, but did not see Poroshenko’s deal or Rozhkova’s case.

Zelenskyy inherited the practice of cooperating with the NABU. We have the same selective blindness. The NABU ‘does not see’ corruption in suspicious transactions worth billions of hryvnias. For example, a cartel in the "Great Construction", the case of a fitness trainer of the Dnipropetrovsk governor or the adventures of Trukhanov. The main example: Ihor Kolomoisky is politely invited to let go after 40 minutes. This is despite the fact that many years ago, he was charged with embezzlement of $ 5.5 billion and now, during the war, he is activating the processes for the return of PrivatBank.

And here you have Shevchenko’s petty business, which is being investigated for 4 years without any results. The fact is that the case must be delayed.

The same old thing happens with Shevchenko that it was not even believed. The case against him was activated on the eve of his appointment as head of the NBU. He was deliberately appointed to such an influential position, despite the case. Then the case ‘disappeared somewhere’, but was not closed. Like, if you don't do what you need, we have a case against you. This is a very typical scheme.

And so, about a year ago, the case was ‘found’. I don't know on which points Shevchenko should have been more accommodating. I suspect that there is a lack of activity of the money machine. Actually, the same claims were to his predecessor Smoliy. Too little money, more should be issued. First for the ‘Great Construction’, and then for filling the budget during the war with Russia. Although it is clear what a large-scale emission can lead to. And not least because of the stubbornness of the NBU leadership, the dollar-hryvnia exchange rate is now 40, not 60. Among other reasons, they say that they wanted Yermak's people to be appointed to the NBU. It might be true, I cannot say for sure.

But there is an indisputable fact: more than six months ago there were active talks that they want to replace Shevchenko with Andrii Pyshnyi. Pyshnyi has one undeniable advantage – he is the godfather of a child of the head of the Office of the President Andrii Yermak. Despite the fact that he is a man of far from impeccable reputation.

The main argument in favor of replacement was that ‘Pyshnyi is better than Shevchenko’. In what sense he is better? ‘He promised to do what Shevchenko did not want to do’.

I don't know what exactly we are talking about. For now, Pyshnyi continues to do all the things his predecessor did. He also maintains a high discount rate. But it is possible that his main affairs are still ahead. There have already been talks about its decline. Currently, Pyshnyy is performing a personnel purge of the NBU, dismissing Shevchenko's people and placing former employees of Oschadbank in positions.

And here is another fact in favour of political pressure. One of Pyshnyy's first cases as head of the NBU is the inspection of Ukrgasbank, which was headed by Kyrylo Shevchenko before his appointment to the NBU. At one of the meetings, Pyshnyy said that about 2000 violations were found. When one of the bankers couldn’t help laughing, Pyshnyi said he could inspect his and find as many violations there. The banker didn't laugh anymore.

This indicates that Pyshnyy acts synchronously with the NABU. I am sure that this is not a desire to help the investigation. Actually, I will believe more in the option that mass personnel changes are being carried out thanks to investigations and inspections. Shevchenko's people are changed to the people of Pyshnyi. If this hypothesis is true, this case will be forgotten as soon as the personnel changes are completed.

This is exactly what a typical settling of scores in the style of Volodymyr Zelenskyy and the head of his Office looks like. The peculiarity of the style is to create pressure from law enforcement officers – but to pretend as if it is not them. That they themselves are on the contrary friends who help with what they can. Although everything indicates – it is them.

Now it is fashionable to consider the NABU as knights of light, who are the only ones in Ukraine who hunt thieves. And as for me, they still need to wash their reputation. Since its inception, there have been too many cases that I would call ‘cooperation’ between the NABU and the current government. Shevchenko's case is one among many.

Much more important were those cases that the NABU closed or did not even open. I think that if cases are not closed, someone needs that too.

I am very much looking forward to a case against corruption at the "Great Construction" or at least about the government's deals. Then I will understand that the NABU performs its function, and does not put on the hook those who were selected by the President's Office.
