MIA on bill No. 10311: National Guard is not being granted powers but only regulates existing ones

The Ministry of Internal Affairs commented on the planned amendments to the law "On the National Guard of Ukraine".

According to the ministry, the bill on improving the legal framework for the use of coercive measures by the National Guard of Ukraine was prepared based on the results of an analysis of the situation in connection with the full-scale armed aggression of the Russian Federation in 2022. It was then submitted to the Verkhovna Rada of Ukraine in December 2023 and considered in the first reading, adopted as a basis in May 2024. On March 5, 2025, it was reviewed and supported by the Verkhovna Rada Committee on Law Enforcement following its preparation for the second reading.

The Ministry of Internal Affairs emphasizes that the National Guard personnel are not being granted additional powers, but rather that existing ones are being clearly regulated. Currently, National Guard servicemen have to apply regulations from multiple normative legal acts simultaneously and rely on laws governing other structures. Draft Law No. 10311 proposes to unify these regulations into a single law governing the activities of the National Guard.

It is noted that servicemen of the National Guard of Ukraine had and continue to have the authority to apply physical force, special means, weapons, arms, and combat equipment to perform their duties, as well as to stop and inspect vehicles. This is precisely how they carried out their duties before the full-scale invasion, throughout 2022, and continue to do so today. It is through these means that they detect sabotage and reconnaissance groups, stop the illegal circulation of weapons, ammunition, and narcotics, and apprehend individuals who have committed crimes or are wanted by law enforcement.

The proposed bill almost completely duplicates some provisions from the Laws of Ukraine "On the National Police", "On the State Border Guard Service of Ukraine", "On Military Law Enforcement Service in the Armed Forces of Ukraine", taking into account the specifics of the tasks and functions assigned to the National Guard.

"In general, the amendments to the law are aimed at detailing the powers of the National Guard and providing a clear regulatory definition of its activities. The law may be subject to amendments and additions at the stage of consideration and adoption," the Ministry of Internal Affairs emphasizes.
