Zelenskyy signs draft law No. 12089, which will allow to keep illegally alienated land

President Volodymyr Zelenskyy has signed Draft Law No. 12089 "On Amendments to the Civil Code of Ukraine on Strengthening the Protection of the Rights of a Good Faith Purchaser".

According to Censor.NET, this was reported by the "Chesno" movement.

The Rada adopted the draft law on 12 March 2025.

What the draft law provides for

  • After 10 years from the date of illegal alienation of a land plot, including forest, coastal and other natural areas, the state or community loses the right to demand the return of these territories;
  • If up to 10 years have passed since the alienation and the court decides to return the land to the state or community, they must pay the owner compensation at market value. However, there is no compensation for losses to the state and territorial community.

However, the draft law provides for exceptions for land of strategic importance, critical infrastructure, the nature conservation fund and cultural heritage, but contains nuances that make such a return difficult or impossible.

"It also fails to take into account that the boundaries of the lands of the nature conservation fund or cultural heritage are often not clearly defined and not recorded in the State Land Cadastre. In such cases, the state completely loses the mechanisms for returning these assets in its favour.

In addition, the wording proposed in the draft law may complicate the return of property and land in the territories of Ukraine temporarily occupied by the Russian Federation, although this was explicitly stated by the Main Legal Department of the Verkhovna Rada," the statement said.

At the end of March, a petition to veto the draft law reached the required 25,000 votes.
