Bill No.12089 legalizes stolen land, it should not be adopted - Shabunin

Bill No. 12089 "On Amendments to the Civil Code of Ukraine to Strengthen the Protection of the Rights of a Bona Fide Purchaser" cannot be adopted.

This was announced on Facebook by the head of the AntAC Vitalii Shabunin, Censor.NET reports.

According to him, the legalization of each stolen piece of land "will be publicly linked to the people's deputies who will vote for it."

Shabunin went on to list the arguments why the bill should not be adopted.

"1) Often, assets that cannot be private at all according to the law were illegally transferred to private ownership through schemes: a coastal strip that blocks people's access to water bodies, forest territory, and there are cases of attempts to appropriate water areas. In fact, this law says that if 10 years have passed, it is all legal.

What is the point of all the legislation on land, forestry and water codes, if we are simply legalizing the scheme of transferring these things to private ownership? ! Moreover, the acquirer of such assets (even if he is a third-party buyer) understands for sure that the coastal strip could not legally become private property. The answer to the question of whether this acquirer is bona fide is obvious.

2) Schemes of land withdrawal are most often organized in such a way that the land passes through several owners and ends up with the final purchaser, who is already supposed to be bona fide. The same schemes with the registration of land for ATO soldiers and its subsequent sale are a clear indication of this. The latest example is the Solskyi case.

3) If prosecutors abuse their powers and demand bribes from bona fide purchasers, is the only way out to legalize the scheme? This is like treating the wrong problem. After all, if prosecutors want a bribe, why doesn't a bona fide purchaser expose such a prosecutor?

4) The criminal case of Mazepa is a separate story. The SBI and the prosecutor's office have not yet shown evidence of Mazepa's involvement in land acquisition schemes. Maybe they will be in court. If there is no such evidence, the only way out is acquittal," he explained.

Shabunin emphasized that law enforcement officers should be punished for any violations, and this requires a fair system of prosecutors' accountability.

"Instead, today the Law Enforcement Committee and the Ombudsman are pushing the prosecutor Koval, who has disgraced our country in front of all international partners, into the Qualification and Disciplinary Commission of Prosecutors ," summarized the AntAC head.
