In compliance with the ruling of the Darnytskyi District Court of Kyiv dated 8 March 2024 in case No. 753/16257/23, which was upheld by the resolution of the Kyiv Court of Appeal dated 28 February 2025, we publish the introductory and operative parts of the court’s decision in this case.

JUDGMENT IN THE NAME OF UKRAINE

On 8 March 2024, the Darnytskyi District Court of Kyiv, presided over by Judge L. M. Osipenko, having considered under the rules of simplified civil proceedings without summoning (notifying) the parties to the case, the civil case brought by Andrii Volodymyrovych Portnov against Yurii Viktorovych Vynnychuk, Olha Yaroslavivna Prokopyshyn, and the online media outlet "Censor.NET," represented by Editor-in-Chief Yurii Yevhenovych Butusov, regarding the protection of honor, dignity, and business reputation, hereby rules as follows:

THE COURT HAS RULED:

The claim of Andrii Volodymyrovych Portnov against Yurii Viktorovych Vynnychuk, Olha Yaroslavivna Prokopyshyn, and the online media outlet "Censor.NET," represented by Editor-in-Chief Yurii Yevhenovych Butusov, regarding the protection of honor, dignity, and business reputation, shall be partially satisfied.

To recognize as false and defamatory with regard to Andrii Volodymyrovych Portnov the information disseminated on 25 August 2023 on the website "Biznes.Censor" (https://censor.net/biz) in the publication entitled:

"Head of the NACP Oleksandr Novikov: 'Certain governments tried to pressure us after their companies were added to the international register of war sponsors'" at the following Internet address:

https://censor.net/biz/resonance/3439596/kerivnyk_nazk_oleksandr_novikov_na_nas_namagalys_tysnuty_okremi_uryady_pislya_togo_yak_yihni

in the following phrase: "...collaborator and traitor Portnov".

To oblige Yurii Viktorovych Vynnychuk and Olha Yaroslavivna Prokopyshyn, within 5 (five) calendar days from the date this decision enters into legal force, to refute the information disseminated on 25 August 2023 in the publication entitled: "Head of the NACP Oleksandr Novikov: 'Certain governments tried to pressure us after their companies were added to the international register of war sponsors'" at the following Internet address:

the false information about Andrii Volodymyrovych Portnov by publishing the introductory and operative parts of the court’s decision in this case on the homepage of the website "Biznes.Censor" (https://censor.net/biz) under the heading "Refutation."

To dismiss the claim of Andrii Volodymyrovych Portnov against the online media outlet "Censor.NET," represented by Editor-in-Chief Yurii Yevhenovych Butusov, regarding the protection of honor, dignity, and business reputation.

To order Yurii Viktorovych Vynnychuk to pay court costs in the amount of 19,506 hryvnias and 93 kopecks to the benefit of Andrii Volodymyrovych Portnov.

To order Olha Yaroslavivna Prokopyshyn to pay court costs in the amount of 19,506 hryvnias and 93 kopecks to the benefit of Andrii Volodymyrovych Portnov.

The court’s decision shall enter into legal force thirty days after the date of its signing and may be appealed to the Kyiv Court of Appeal.

A party to the case who did not receive a copy of the court’s decision on the day it was signed has the right to request the renewal of the time limit for filing an appeal, provided that the appeal is submitted within thirty days from the date of receipt of the copy.

In the event of an appeal, the court’s decision shall enter into legal force upon the adoption by the appellate court of a ruling to deny the opening of appellate proceedings, to return the appeal, to close the appellate proceedings, or to leave the appeal without consideration or without satisfaction.
