While I was shedding blood for Ukraine on frontline, my property became object of raider seizure - warrior Volodymyr Sainchuk
Raiders cynically and systematically appropriate my property while I am shedding blood for my homeland. When I returned from the war to civilian life seriously wounded, I did not expect that the biggest enemy was not those we were fighting against, but those who were close to us. Raiding is rampant in the city of Yahotyn, and this shameful phenomenon, unfortunately, has affected me personally.
I am, Volodymyr Sainchuk, a serviceman of the Armed Forces of Ukraine, was seriously wounded in battle and survived thanks to my equipment. I went through a real "hell" when applying for a disability group, as I do not have a "privileged prosecutor's rank" and am an ordinary soldier - a scout, but, unfortunately, this is not my biggest problem. For the third year in a row, I have not been able to get into my own premises. Even worse, I cannot understand why I, the rightful owner, am standing in front of my own door, which is locked by third parties.
Raiders in the law?
My real estate in the Kyiv region, Yahotyn, at 9 Pyriatynska Street (317 sq. m.) was purchased from PJSC "NASK Oranta" in September 2021. All documents are in order, the sale and purchase agreement is notarised, but I cannot use my property. Having become the new owner of the property, I offered to sign a new lease agreement with the previous tenants of my premises, "Manad" LLC (EDRPOU 32670436), but they refused. A refusal is a refusal. However, as a result, "Manad" LLC did not vacate the premises, has been occupying it for three years without any right, does not pay rent or utilities, and most importantly, grossly obstructs my access to my property.
These so-called businessmen brazenly decided to steal something that does not belong to them either legally or conceptually. For three years, "Manad" LLC, headed by Mikhail Surai and Roman Makarchuk, have been breaking the law and using my premises. They do not pay for utilities, not to mention rent, and they also block my access to the building by force. I was hoping to rent out the premises and make a profit, as due to my injury and disability group, this would have been my only source of income.
The fact that I was defending Ukraine at the frontline and could not follow the court hearings, which they initiated to gain time and delay the process, played into their hands. But don't think it's just a matter of time! This is a planned scheme of moral exhaustion - to make me desperate and nervous.
Manad versus justice.
In November 2021, "Manad" LLC filed a lawsuit demanding to transfer ownership of the property to itself. They claimed that they had a pre-emptive right to purchase the premises, as they had leased it for five years. According to them, the seller, "Oranta", failed to notify them of the sale, depriving them of the opportunity to buy the property.
But all of these statements are nonsense! As far as I know, "Oranta" offered "Manad" to buy the premises, but they refused because of the established market value. They hoped to get it for nothing, but it didn't work out. That's why they started playing court games.
In November 2021, I filed a counterclaim demanding that "Manad" be evicted from my premises. But, as I have already mentioned, the war played into their hands - I could not attend the hearings. The trial dragged on for almost three years, and in the third year of the proceedings, the court issued a 186-page judgement. Manad's claims were rejected, but my counterclaim was also denied. What kind of a circus is this? Is this a state governed by the rule of law?
The court game of delay.
This is a mockery of a wounded veteran - the court left "Manad" in the premises, as if their illegal use could last for another three years, or even longer. The court made a 186-page decision to "throw" me into the appellate instance for another three years. This is a direct encouragement of raiding! Instead of protecting my legal rights, I am being deliberately pushed into new legal wars.
I only hope for a fair hearing in the Kyiv Court of Appeal, which will take place on 6 November at 15:00 with judges Stryzheus A.M., Shkorina O.I., Polyvach L.D. I believe with all my heart that the judges of the highest court are free from pressure and bias and will make a decision according to the law.
Police: just observers?
Another important point is the complete inactivity of the so-called law enforcement agencies. The police simply arrive at my call and "throw up their hands". I am literally humiliated in front of my own property, and law enforcement officers do nothing. My reports of criminal offences are ignored or not properly investigated. How is this possible? They are either intimidated or bought - there are simply no other options.
Exhausted, but not broken.
Tired of the accumulation of utility debt for the illegal use of utilities by "Manad" LLC, I was forced to cut off their electricity. But they arbitrarily, without any rights, found a fraudulent way to reconnect the electricity separately. It turns out that I, the legal owner, am an empty space for them. I can't get into my premises, I can't rent it out, I don't get the profit I was expecting. With the support of the leaders, Mikhail Surai and Roman Makarchuk, "Manad" has been using my property for three years without paying a penny, and the courts and police have only helped them in this lawlessness. They are trying to break me psychologically, to make me give up my property.
But I will not give up. I hope that fair justice will prevail. And if the courts do not hear me, I will appeal to the public. Ukraine deserves to have no place for such scammers. We, the military, risk our lives for the future of this country and will not allow it to be destroyed from within by raiders and their accomplices.
