NABU exposes scheme of illegal access to classified court rulings

The NABU and the SAPO have served two lawyers and the actual head of the law firm with a notice of suspicion of unauthorized access to the classified part of the Unified State Register of Court Decisions (USRCD).

According to the investigation, starting in August 2022, the suspects gained access to the closed register of court decisions and began to systematically use this data to automatically obtain information on the results of court consideration of motions from law enforcement agencies and prosecutors. For this purpose, a special script was developed that collected data and content of new court decisions on lawyers' clients every 12 hours and allowed manual searching of the register.
According to the NABU, the court decisions obtained through both functions were used by lawyers in their activities. In particular, the suspects monitored judges' rulings on authorizing searches and other investigative actions to warn their clients. The illegally obtained data was used to prepare for investigative actions, destroy material evidence and documents, and evade criminal liability of the advocates' clients.
As a result of this criminal scheme, 39,615 search queries were made and 7,572 court decisions were reviewed. The actions of the criminals are qualified under Part 2 of Art. 376-1 of the Criminal Code of Ukraine.
