Government clarifies grounds for military exemption of employees from mobilization

The Cabinet of Ministers has clarified the grounds for military exemption of persons liable for military service during mobilization and martial law.

The relevant changes are provided for by Cabinet of Ministers Resolution No. 1106 of 8 September 2025, BusinessCensor reports.

In particular, the resolution refines the military exemption mechanism for businesses in frontline areas and for enterprises producing unmanned systems, specifically, the government clarified the rule allowing 100% military exemption for employees of critically important enterprises in frontline regions.

Such military exemption may be granted "in areas of active hostilities where state electronic information resources are functioning."

As reported earlier, the Cabinet had already allowed 100% military exemption of employees liable for military service at critically important enterprises operating in combat zones. The definition of these areas has now been clarified.

In addition, the Cabinet transferred electronic registries of the Ministry for Strategic Industries to the Ministry of Defense. Due to this technical issue, the registries had been unable to operate, creating problems for defense-industrial enterprises.

Separately, the government expanded the criteria for critically important enterprises eligible to exempt employees to include contractors under state contracts for the production of unmanned systems, weapons, military and special equipment, ammunition and components, and other defense-purpose goods commissioned by the Administration of the State Service of Special Communications and Information Protection (SSSCIP) and other state defense customers.

The respective amendments were made to Cabinet Resolution No. 76 of 27 January 2023.

The Ministry of Economy noted that the economic effect of the decision, preserved GDP and tax revenues, could reach about 2.25 billion hryvnias per year.

As reported earlier, the Rada approved a draft law on temporary military exemption for those who have issues with the Territorial Center of Recruitment and Social Support (TCR and SS).
