Misappropriation of 5.6 million hryvnias during procurement of electronic warfare equipment for military unit: members of organised group to stand trial. PHOTOS

An indictment has been filed in court against four members of an organised group accused of embezzling 5.6 million hryvnias allocated to support the military.

What is known

It is reported that the scheme was organised by a businessman, who enlisted the help of the director of a municipal enterprise, a lawyer and the director of a private company.

Fictitious letters were sent to the military administration on behalf of military units carrying out combat missions in the Donetsk and Zaporizhzhia regions, requesting the purchase of electronic warfare equipment. On the basis of these letters, the military administration allocated funds to the municipal enterprise. Subsequently, the municipal enterprise entered into two contracts with affiliated companies for the supply of electronic warfare equipment, which was in fact neither purchased nor handed over to the military.

To create the appearance of fulfilling the contracts, they drew up forged acceptance and handover certificates, delivery notes and other documents, in particular using the details of companies and military units. After payment for the non-existent electronic warfare equipment, the funds were transferred via controlled companies, withdrawn as cash and distributed amongst the group’s members.

It is reported that the total amount of losses incurred amounts to 5.6 million hryvnias.

What are the consequences?

As follows:

  • the organiser’s actions were classified under Part 3 of Article 27, Part 5 of Article 191 and Part 2 of Article 209 of the Criminal Code of Ukraine;
  • the director of the municipal enterprise – under Part 2 of Article 27 and Part 5 of Article 191 of the Criminal Code of Ukraine;
  • the lawyer – under Part 5 of Article 27 and Part 5 of Article 191 of the Criminal Code of Ukraine;
  • the director of the limited liability company – under Part 5 of Article 191 of the Criminal Code of Ukraine.

Fake procurement of electronic warfare equipment

The Public Prosecutor’s Office has filed a civil claim for compensation for the damage caused to the state, represented by the Siverskodonetsk City Military Administration.

The defendants face a prison sentence of between 7 and 12 years, along with a ban on holding certain positions or engaging in certain activities for up to 3 years, and the confiscation of their property.
